
On January 3rd, the Express Times published a Letter to the Editor I had written condensed from “Health Care is NOT a Right.“ On January 6th, a resident replied back and was published in the newspaper. I wrote a reply back to editor (within the 250 word limit) the same morning, but it looks as if it will not be published and I could not find a URL online. Since the newspaper did not mention I was a congressional candidate in the letter, I have no idea if the resident is even aware of this.
Below is my reply, verbatim, followed by a press release on my latest article on state nullification of the health care tax bill.

I would like to reply to [name removed]‘s response to my letter stating that health care is not a legal right. I agree with much of what she wrote regarding the US Constitution, save her conclusion that the current health tax bill confirms a legal right to health care after it passes. In fact, this is why I referenced the USSR’s Constitution – they legalized a right to health care via a constitutional amendment. We have not. This is the lawful route that supporters of a right to health care should pursue.
The House Speaker believes Congress’s constitutional power over health care is “essentially unlimited.” This is a gross misinterpretation - the Commerce Clause does not give Congress unlimited power over health care, just to smooth out transactions from state to state. And I do believe in insurance portability among the states, unlike Congress.
I do not support the current unconstitutional legislation because it has a high probability of disaster for the entire country. The states can function as “50 laboratories” for experimentation, but none so far have been successful. Looking to a federal government with Medicare’s $85 trillion in UNFUNDED liabilities to solve our coverage problems is insane. No one wants a bureaucrat deciding who gets what care. Few in Congress address the root causes – a government-sponsored health insurance cartel, and malicious legislation like the HMO Act of 1973. My campaign plank is centered on providing affordable, high-quality health care.

Independent Congressional Candidate Calls for Nullification of Health Care Tax
The campaigns’ common sense, concrete solutions for lower costs, higher quality, and more features are listed on the campaign website, in addition to the constitutional and moral position that health care is not a legal right. Towne has promised to accept only the median household income for a salary, and will donate the remainder to local non-profit hospitals, and has pledged to not enroll in the elite congressional health care plan. Towne presents the American people with the choice they SHOULD have in “Guns or Health Care?” as most people do not understand the insane cost of a military that costs more than the rest of the planet COMBINED.
Towne points out that the next line of defense to be pursue once the health care tax is signed into “law” is state nullification. We must keep in mind at all times that the states created the federal government, and not vice versa. Contrary to today’s Congress, the American people are given very little say to debate with their representatives, which Towne’s “Our Open Office” plan will solve.
However, although seldom exercised, the states have the unquestionable right and power to strike down legislation that is unconstitutional by nullifying the act. Thomas Jefferson, the same fellow who penned “life, liberty, and the pursuit of happiness,” also authored the Kentucky Resolution of 1798 and assisted James Madison with the Virginia Resolution of 1798 which highlight state rights to nullify unconstitutional federal acts.
